Kamu görevlileri, görevlerinin bir parçası olarak işlemleri yerine getirirken kamu idaresine ait olan ve gizli kalması gereken pek çok bilgiye de vakıf olmaktadırlar. Bu durum, onların görevlerinin ve bulundukları konumun doğal bir sonucudur. İşte bu nedenle kamu görevlilerinin, görevleri dolayısıyla öğrendikleri gizli kalması gereken bilgileri saklama yükümlülüğü öngörülmüştür. Söz konusu yükümlülüğe aykırı nitelikteki davranışlar ise 5237 sayılı TCK’nın 258. maddesinde cezai açıdan yaptırıma bağlanmıştır. Kamu görevlilerinin kamu idaresine karşı olan sadakat borcuna uygun biçimde davranması ile birlikte kamu idaresinin güvenilirliği ve işleyiş düzeni teminat altına alınmıştır. Bu çalışmada göreve ilişkin sırrın açıklanması suçu unsurlarıyla birlikte ele alınacak, bu suçun benzer suçlarla olan farkları incelenecektir. Ayrıca Türk Hukuku’nda verilmiş yargı kararları ile birlikte İCK’daki düzenlemeler ve İtalyan Hukuku’ndaki görüşler göz önünde bulundurularak açıklamalarda bulunulacaktır.
Public officials know a lot of information that belongs to the public administration and must be kept secret, while performing operations as part of their duties. This situation is a consequence of their duties and the position they are in. For this reason, the obligation of public officials to keep information that they have learned because of their duties should be kept secret. Conducts in contradiction to this obligation is punished in Article 258 of the Turkish Criminal Code No. of 5237. With public officials acting in accordance with the loyalty to the public administration, the reliability and operation of the public administration is guaranteed. In this study, the crime of disclosure of the secret related to public service will be treated together with the elements of the crime and the differences of this crime with similar crimes will be examined. In addition, the judicial decisions given in the Turkish Law and the regulations in the Italian Criminal Code and the doctrine in the Italian Law will be taken into account.
