Sporun haklar içerisindeki yerinin tespiti kendisinin başlı başına bir hak olarak kabul edilip edilmeyeceği aklımızda yer alan bir sorudur. Bu sorunun cevabını bulabilmek için öncelikle spor faaliyetinin tanımı, spor çeşitlerinin ayırımını ve nihayet bu faaliyetin çeşitli haklar içerisindeki görünümü değerlendirilmiştir. Sporun tarihsel gelişiminin de kısaca ele alındığı bu çalışmada Türkiye Cumhuriyeti Anayasası'nın 59. maddesi değerlendirilmiş ve yine Anayasamızın sağlık hakkı, çalışma özgürlüğü ve hakkı ile eğitim hakkı içerisindeki yeri ele alınmıştır. Karşılaştırmalı hukuktan ve bunların yasal düzenlemelerinden de örnekler verilmek suretiyle, bu ülke iç hukuklarında sporun yeri tespit edilmeye çalışılmıştır. Bu çalışma, iç hukukumuzda sporun bir hak olarak yerini tespit bakımından bir değerlendirme kıstası olarak ele alınmıştır. Karşılaştırmanın sonunda ise bu ülkelerin gerek mevzuatında gerekse uygulamasında sporun bağımsız bir hak olarak ele alınmadığı görülmüştür. Bu değerlendirmelerin sonunda ise kişisel kanaatimiz ortaya konulmak suretiyle çalışmamız tamamlanmıştır.
The position of sport in the rights is a question that comes into mind whether it itself is considered as a right alone. In order to find the answer to this question, it was first assessed the definition of sports activity, the distinction of sports varieties and finally the appearance of this activity within the various rights. In this study, the historic development of sport is also briefly discussed, the article 59 of the Constitution of the Republic of Turkey has been evaluated and again the place of our Constitution in health, freedom of work and the right to education. By giving examples of comparative law and its legal regulations, this country’s domestic law has been attempted to determine the place of sport. This study has been treated as an assessment of the place of sport as a right in our domestic law. At the end of the comparison, it has been shown that these countries are not considered as an independent right in their legislation or practice. At the end of this evaluation, we have completed our work with the way our personal identity is revealed.
