Zamanaşımı bazı hukuki ve sosyolojik gerekçelerle birçok hukuk sistemi tarafından eskiden beri kabul görmüş bir müessesedir. "Kazandırıcı" ve "düşürücü" olmak üzere iki tür zamanaşımı vardır. Kazandırıcı zamanaşımını kabul etmeyen İslam Hukuku, gerek hukuk gerekse ceza davalarında düşürücü zamanaşımmı benimsemiştir. Bu hukukun uygulama sürecinde önceleri, hâkim zamanaşımını hukuk davalarında kendiliğinden dikkate alırken; sonraları davalı tarafından ileri sürülmesi halinde göz önüne alınması gerekir şeklinde bir görüş benimsenmiştir. Bu makalede zamanaşımının hukuk davalarında sadece davalı tarafından ileri sürülmesi halinde dikkate alınmasının, İslam Hukuku'nun kabullerine daha uygun olacağı görüşü ileri sürülmüştür.
