Abstract Through an approach from the demographic perspective, an attempt is made to debate the relevance of the retroactive marriage in force for some years in the Cuban family code. The objective is to reflect on general aspects of marriage in Cuba, so that it is possible to establish a dialogue specifically regarding retroactive marriage. For this, the ideas are presented from an evaluation of the sociodemographic and legal conditions in which this arises. Some fragments of in-depth interviews from a case study carried out in Havana City in 2008, on decisions to start a family, are used. The selection sought to guarantee heterogeneity in terms of educational level, occupation, migratory status, and marital status.
