Konvansiyonel bankacılık ve finans alanındaki gelişmelerle birlikte, İslami açıdan faaliyet gösteren finansal kurumlarda ve ürünlerde artış görülmektedir. Bankacılık ve finans faaliyetlerinin İslami açından değerlendirilmesi esnasında, kullanılan ürün ve hizmetlerin İslami değerlere uygunluğu baz alınmakta, uygun olmayan ürünler ya kabul görmemekte ya da İslami değerlere uygun hale getirilmeye çalışılmaktadır. İslami finans sisteminde finansman ihtiyaçlarının karşılanması için ortaya çıkan finansman yöntemlerinden biri de vekâlet sözleşmesi denilen akit türüdür. Bu yöntemde yatırımcı ücreti karşılığında bir vekil tayin eder, vekil de daha önceden belirlenen bir yüzdede getiri elde etmek için bu sermaye ile ticaret yapar. Çalışmanın temel amacı, yeni bir fon toplama yöntemi olarak ‘Vekâlet’ yöntemini hukuki, fıkhi, iktisadi açından değerlendimek ve İslami finans kurumları için İslami ilkelere uygun standart bir model önerisi sunmaktır. Türkiye’de özellikle katılım bankaları tarafından kısa vadeli ve yurtdışı kaynaklı fon temini amacıyla kullanılan ‘vekâlet’ ürününün, henüz yeteri kadar uygulama alanı bulmadığı veya uygulansa dahi kısıtlı bir düzeyde olduğu ve uygulanan kısmının ise doğru olarak sisteme entegre edilmediği gözlemlenmektedir. Faizsiz bankacılık ilkelerine ve İslami değerlere uygun bir şekilde uygulandığı takdirde ‘Vekâlet Usulüyle Fon Toplanması ve İşletilmesi’ yönteminin, birey bazında fon sahiplerinin âtıl fonlarının ekonomiye kazandırılması açısından önemli bir yöntem olduğu ve faizsiz bankacılık alanında katma değer oluşturacağına kanaat getirilmiştir. Araştırma kapsamında bu finansman türünün içeriği, hukuki ve fıkhi dayanakları, dünya ve Türkiye finans sistemindeki yeri, diğer akit türleri ile farkı incelenmiştir. Ortaya çıkan sonuçlar ve değerlendirmeler, sektör yöneticileri ile araştırmacılar için bilgiler ve politika yapıcıları için öneriler sunmaktadır.
With the developments in the conventional banking and finance, there is an increase in the financial institutions and products that operate in the Islamic perspective. One of the methods of financing that arise in the Islamic financial system to meet the needs of financing is the type of acts called a contract of advocates. Along with the developments in conventional banking and finance, there has been an increase in the number of instruments and financial institutions operating in Islamic finance. During the evaluation of banking and finance activities from the Islamic point of view, the products and services used are based on their conformity to Islamic values. Incompatible products are either not accepted or attempted to be adapted to Islamic values. One of the financing methods to meet the financial needs in Islamic finance system is the type of contract of so-called the agency agreement. In this type of financing, one assigns an agency for the investor's fee, and the agency trades with this fund to obtain a predetermined percentage return. The main aim of the study is to evaluate the "Investment Agency-al Wakalah Bi Al-Istithmar” method in terms of legal, sharia, financial and economic as a method of collecting new funds or liabilities and to present a standard model proposal in compliance with Islamic principles for Islamic financial institutions. In Turkey, it has been observed that the Investment Mandate product, which is used by the participation banks for the purpose of short-term funding from abroad, has not been applied yet. If applied in accordance with interest-free banking principles and Islamic values, “Collection Fund Using Wakala Method” method is considered to be an important method in terms of earning the idle funds of the fund holders on an individual basis and added value in the field of interest-free banking in our country. Within the scope of this research, the content of this financing, its legal and fiqh basis, its position in the world and Turkish system, and its differences with other contract types have examined. The resulting outcomes and evaluations will provide information for the industry executives, researchers and will provide proposals for policy makers.
