Abstract:

Discipline crimes means the behaviors or attitudes violating the norms which arrange the statues of staff (personnel).There are three main principles about discipline law in 1982 Constitution. These principles are lawfulness, right of defense and judicial assurance.In spite of the principle of analogy isn’t accepted in penalty law, this principle is effective in discipline law. So we can say this acceptance violates the rule of law. The right of defense is one of the basic principles of human rights. According to the right of defense, the accused must be informed about the subject of accusation and sufficient space of time must be given for defense.The limitations over the judicial inspection constitutes incongruity to the principle of rule of law
