Abstract:

The information that belongs to a particular person and makes it possible to identify that person is personal data. Personal data is personal to the person and is an element of the personal life of the person. The capture of personal data without the consent or request of the person concerned, the provision or dissemination to others means the disclosure of information about the person’s private life. This also means an attack on the privacy of the private life, which is one of the most fundamental rights of the person, which is defined in Article 20 of the Constitution of the Republic of Turkey. The conditions of our time also require that the personal data that is so important be protected more accurately. The legal value intended to be protected by the offence "to give or capture data in violation of law" established in TCK m.136 is also the part of the private life that relates to personal data. In our study, we will investigate the misconduct according to the method of criminal investigation; we will refer to the quality of the crime, the specific appearance and judgment.
