Abstract:

Our current legal system involves provisions that need to be clarified in certain aspects. A subject matter which requires to be discussed in this context is whether legal person merchants and especially the companies may be qualified as consumers or not. In fact, on one hand there are the Turkish Commercial Code provisions disallowing legal person merchants and especially the companies to have an ordinary scope outside their mercantile aff airs; and on the other hand, there is the Act on Consumer Protection qualifying “any legal person who acts for purposes outside his trade or profession” as a consumer. In this case, how should these confl icting provisions be interpreted? This article intends to answer the aforementioned question and come up with a lawful solution, since it is crucial to elaborate and illuminate the subject matter in order to prevent inequitable practices
