Bitcoin, ortaya çıktığı 2009 yılından bu yana ciddi bir şekilde değer kazanmış ve yaygınlaşmıştır. Bu süreçte Bitcoin hakkında bir para mı, emtia mı, bir çeşit teminat mı gibi sorular gündeme gelmiş ve farklı farklı nitelendirmeler yapılmıştır. Halen dünya genelinde Bitcoin için benimsenmiş tek bir tanım/tarif veya niteleme bulunmamaktadır. Hal böyle olunca, taraflardan birinin bir malın mülkiyetini nakletmeyi diğer tarafın da buna karşılık Bitcoinin ile ödeme yapmayı borçlandığı sözleşmelerin nitelendirilmesi de farklılık arz edebilecektir. Zira satış sözleşmelerinde bedelin, bir miktar para olduğu kabul edilmektedir. Dolayısıyla Bitcoinin para niteliğinde olup olmadığının ortaya konulması, sözleşmenin niteliğinin belirlenmesi bakımından önem arz etmektedir. Bu çalışma ile söz konusu meseleye çözüm aranması amaçlanmaktadır. Bu kapsamda, çalışmada öncelikle genel açıklamalardan sonra satış sözleşmesinin bedel unsuru ele alınmıştır. Akabinde Bitcoinin ne olduğu ayrıntılı bir şekilde izah edilmiştir. Nihayet meseleye ilişkin değerlendirmeler ve sonuç yazılarak çalışma tamamlanmıştır.
Since 2009, Bitcoin has gained tremendous value and has become widespread. In this process, questions such as money, commodity, some kind of collateral about Bitcoin have come into question and different qualifications have been made. Currently there is no single definition/description or qualification adopted for Bitcoin worldwide. As such, the qualification of contracts in which one of the parties must transfer the ownership of a good and the other party to pay with Bitcoin may differ. Because in sales contracts, the price is considered to be some money. Therefore, revealing whether Bitcoin is in the form of money is important in terms of determining the quality of the contract. With this study, it is aimed to search for a solution to this issue. In this context, first, the charge element of the sales contract is discussed after general explanations. Then, what Bitcoin is explained in detail. Finally, the study is completed by writing the analysis on the matter and the conclusion.
