Abstract:

Erken modern Osmanlı İmparatorluğu’nda önemli bir beylerbeyliği olan Mısır’daki siyaset-hukuk ikilemini ele alan James E. Baldwin, söz konusu eserinde özellikle XVII. ve XVIII. yüzyıllar üzerinden Mısır’da İslam hukukuna siyasi otoritenin müdahelesinin bulunduğunu göstermeye çalışmaktadır. Ancak yaygın kanaatin aksine bu müdahelenin yerel talepler neticesinde gerçekleştiğini belirten Baldwin, Osmanlıların bölgedeki hukuk politikalarının kısmî bir başarı elde ettiği ve tam anlamıyla bir Hanefîleştirmenin XIX. yüzyılda Mehmet Ali Paşa’nın hukuk reformlarıyla gerçekleşebildiği sonucuna varmaktadır.

Abstract:

Addressing the political-legal dilemma in Egypt, which was an important beglerbeg in the early modern Ottoman Empire, James E. Baldwin aims to show that Islamic law in Egypt was never a pristine sphere uncontaminated by political involvement, especially over the XVII and XVIII centuries. However, the contrary to the common opinion, Baldwin, who found that this intervention took place as a result of local demands, concludes that policies of the law of the Ottomans in the region have achieved partial success and that the formation of a literal Hanafization could only took place in the XIX century with the law reforms of Mehmet Ali Pasha.
