Ombudsmanlık Kurumu 2012 yılında faaliyete geçmiş ve 2013 yılından bu yana şikâyet başvurularını sonuca bağlayan bir kamusal denetim mekanizmasıdır. Kurum, söz konusu denetlemeyi hem bir kamusal denetleme aracı olarak hem de bir insan hakkı kurumu olarak gerçekleştirmektedir. Ombudsmanlık Kurumu, vatandaş ve kamu kurumları arasındaki sorunları ücretsiz ve dostane bir şekilde çözmektedir. Böylece Kurum, adaletin tesis edilmesine katkı sunmakta ve yargının yükünü hafifletmektedir. Kuruma gelen şikâyet başvuruları inceleme ve araştırma süreci sonunda red kararı, tavsiye kararı, dostane çözüm kararı, karar verilmesine yer olmadığına dair karar gibi karar türlerinden biri verilerek sonuca ulaştırılmaktadır. Çalışmada Ombudsmanlık Kurumu tarafından verilen kararlar dikkate alınarak kurumun yaptırım gücü, uzmanlaşma alanı, arabuluculuk rolü, adaleti tesis etme, kamuyu koruma gibi kriterler bağlamında kurumsal etkinliği ele alınmıştır.
The Ombudsman is a public audit mechanism that has been operating in 2012 and has been linking the results of complaints since 2013. The agency carries out that supervision as a public supervision tool as well as as as a human rights institution. The Ombudsman agency solves problems between citizens and public institutions in a free and friendly way. Thus, the institution contributes to the establishment of justice and relieves the burden of justice. Applications from the institution are reviewed and the research process is concluded by giving one of the types of decisions, such as the red decision, the advisory decision, the friendly solution decision, the decision that there is no place to make a decision. In the study, taking into account the decisions made by the Ombudsman Board; the institution’s sanctioning power, the field of specialization, the role of mediation, establishment of justice, the protection of the public, the corporate effectiveness in the context of criteria.
The Ombudsman Institution was established in 2012. It is a public audit mechanism that concludes complaint applications since 2013. The institution carries out the audit task both as a public audit mechanism and as a human rights institution. The Ombudsman Institution solves the problems between citizens and public institutions in a free and friendly manner. Thus, the Institution contributes to the establishment of justice and relieves the burden of the judiciary. Complaint applications submitted to the institution are first subjected to an examination and investigation process. At the end of this examination and research process, one of the decision types such as "refusal decision", "recommendation decision", “amicable settlement decision” and “decisions as to no ground exists for taking decision” is given and then the complaint application is concluded. In the study, the decisions made by the Ombudsman Institution were taken into account. In this framework, the institution's institutional effectiveness was analyzed in the context of criteria such as sanction power, specialization area, mediation role, establishing justice, and protecting the public.
