Bina veya yapı eseri malikinin sorumluluğu, Türk Borçlar Kanunu’nda düzenlenmiş kusursuz sorumluluk hallerinden biridir. Bu sorumluluk, bina veya yapı eserinin yapılışından kaynaklanan veya bakımındaki eksiklik sebebiyle ortaya çıkan bir sorumluluktur. Bina veya yapı eseri malikinin sorumluluğu, Osmanlı uygulamasında da yer bulmuştur. Bu çalışma bina veya yapı eseri malikinin sorumluluğunu, Osmanlı hukuku bakımından ortaya koymayı amaçlamıştır. Bu sorumluluğunun hukuki niteliği, şartları ve sonuçları, Osmanlı hukukunda incelenmiştir. Osmanlı hukukunda teoride ve uygulamada, bina veya yapı eseri malikinin sorumlu kabul edildiği örnekler bulunmaktadır. Fıkıh kaynaklarındaki kurallardan ve uygulamadaki örneklerden, sorumluluğa ilişkin bilgiler ortaya konulmuştur. Günümüz hukukundaki hukuki nitelendirme, şartlar ve sonuçlar, Osmanlı hukuku ile karşılaştırılmıştır. Benzer örnekler ve farklı görüşlerle, benzerlik ve farklılıklar ortaya konulmuştur. Osmanlı hukukunda bina veya yapı eseri malikinin sorumlu kabul edildiği durumlar vardır. Sorumluluk, genellikle kusur sorumluluğu şeklinde kabul edilmiş, kusursuz sorumluluk halleri oldukça kısıtlı kalmıştır. Yine de zarar, hakkaniyet, tehlike, genel özen gibi kusursuz sorumluluk düşüncelerinin etkileri olmuştur.
The liability of the owner of the building or building is one of the state of absolute liability regulated by the Turkish Debt Act. This liability is a liability arising from the construction of a building or building work or arising from a lack of maintenance. The responsibility of the owner of the building or building works has also found place in the Ottoman application. This work aims to reveal the responsibility of the owner of the building or building work, in terms of the Ottoman law. The legal nature, conditions and consequences of this responsibility are examined in the Ottoman law. In the theory and practice of the Ottoman law, there are examples that the owner of the building or building works is considered responsible. From the rules and examples in the application in the sources of fiction, information on responsibility has been revealed. The legal qualifications, conditions and consequences of today's law are compared to the Ottoman law. Similar examples and different opinions reveal similarities and differences. In the Ottoman law there are cases in which the property of the building or building works is considered responsible. Responsibility is often accepted in the form of defective responsibility, and the perfect responsibility conditions remain quite limited. Nevertheless, there have been the effects of the thoughts of perfect responsibility, such as harm, justice, danger, general care.
The liability of building or construction owner is an absolute liability which sett-led in Turkish Code Obligation. This liability is due to the failure in the building or construction or lack of care. The liability of building or construction owner was also found in Ottoman law. This work aimed to reveal the responsibility of the liability of building or construction owner in terms of Ottoman law. The legal nature, the conditions and results of liability of building or construction owner were examined in Ottoman law. In theory and practice in Ottoman law, there are examples where the owner of a building or structure is considered responsible. The rules in fiqh sources and examples in practice were used in this work. Today's legal regulations have been compared with Ottoman law. There are similarities and differences between mo-dern Turkish law and Ottoman law about the liability of building or constructure owner.
