Kamu hizmetinin kalitesinin arttırılması ve sürekliliğinin sağlanması için liyakat ilkesinin personel sistemine ve kurumsal kültüre yerleşmesi gerekmektedir. Bu doğrultuda birçok demokratik ülke liyakat ilkesi gereğince anayasal ve yasal kurallar koymanın yanı sıra, bu kuralları uygulayacak ve gözetecek mekanizmaları da tesis etmiştir. Köklü bir geçmişi olan ve tarihsel sürece bakıldığında liyakat ilkesini idari geleneğinde ve mevzuatında bulunduran Türk kamu yönetimi açısından ise bu mekanizmaların yeterli düzeyde tesis edilmediği ve ilkenin uygulanmadığı yönünde bazı ülke örneklerinden hareketle çeşitli eleştiriler bulunmaktadır. Bununla birlikte liyakat ilkesinin uygulanmasını sağlayıcı mekanizmalar açısından yakın zamanda Türkiye’de devlet teşkilatlanmasında yeni bir görünümün olduğunu söylemek mümkündür. Bu çalışmada Türkiye’de kamu kurumlarının personel sistemi çerçevesindeki uygulamalarını ve kararlarını liyakat ilkesi açısından denetleyen kurumların mevzuat çerçevesindeki rolleri ortaya konulacaktır. Mevzuat çerçevesinden ve devlet teşkilatındaki konumları üzerinden etkinlikleri değerlendirilecek olan bu mekanizmaların uygulama detayları ise çalışmanın sınırlılığı nedeni ile ele alınmayacaktır. Literatür ve mevzuat taraması yöntemi ile hazırlanan bu çalışmanın hedefi, liyakat ilkesinin tesisi açısından farkındalık oluşturmaktır.
In order to improve the quality and continuity of public service, the principle of loyalty must be placed in the staff system and corporate culture. In this regard, many democratic countries have established constitutional and legal rules in accordance with the principle of law, as well as mechanisms to apply and monitor these rules. In terms of the Turkish public administration, which has a rooted history and historically has the principle of license in the administrative tradition and legislation, there are various criticisms from the examples of some countries in the direction that these mechanisms are not established at a sufficient level and that the principle is not applied. However, it is possible to say that from the point of view of the mechanisms that provide the implementation of the principle of liakat, there has been a new appearance in the government organization in Turkey recently. This study will show the roles in the legislative framework of the institutions that monitor the practices and decisions of public institutions in the framework of the personnel system in Turkey in terms of the principle of license. The implementation details of these mechanisms, which will be assessed through the regulatory framework and their positions in the state agency, will not be addressed by the reason of the limitation of the work. The aim of this study, prepared with the method of literature and legislation scan, is to create awareness from the point of view of the facility of the law.

In terms of Turkish public administration, which has a deep-rooted history and has the principle of merit in its administrative tradition and legislation, there are various criticisms based on some country examples that these mechanisms are not adequately established and the principle is not implemented. However, it is possible to say that there has recently been a new outlook in state organization in Turkey in terms of mechanisms that ensure the implementation of the principle of merit. In this study, the roles of institutions that supervise the practices and decisions of public institutions within the framework of the personnel system in terms of the principle of merit will be revealed within the framework of the legislation. The implementation details of these mechanisms, whose effectiveness will be evaluated within the framework of the legislation and their positions in the state organization, will not be discussed due to the limitation of the study. The aim of this study, which was prepared with the method of literature and legislation scanning, is to raise awareness in terms of establishing the principle of merit.
