Türk Hukuku’nda ipotek hakkı, aynı kişiden olan birden fazla alacağın güvence altına alınması için kullanılabilir. Teminat kapsamındaki değişik alacakların niteliğine göre başlatılacak olan icra takipleri farklı kurallara tabi olabileceği gibi ilgili alacakların muacceliyet anları da farklılık gösterebilir. Zira ipotekle teminat altına alınan alacaklardan biri diğerinden daha önce muaccel hale gelebileceği gibi bu alacaklardan biri ödeme emrine diğeri ise icra emrine konu olabilir. Yargıtay bu hallerde meseleyi çözmek için “ipotek hakkının bölünmezliği” ilkesini geliştirmiştir. Bu ilke doğrultusunda Yargıtay, teminat kapsamındaki tüm alacakların tek bir icra takibi içerisinde öne sürülmesi gerektiğini ve (alacaklardan biri için icra emrinin gönderilmesi mümkün olsa dahi) borçluya yalnızca ödeme emrinin gönderilebileceğini kabul etmektedir. Çalışmada ipotek hakkının bölünmezliği ilkesinin bu sonuçları ayrı ayrı değerlendirilmiştir. Buna göre, Yargıtay’ın görüşünün aksine, ipotek hakkının birden fazla alacağı teminat altına alması halinde bu alacakların hem farklı icra takiplerine konu olabilecekleri (“tek takip” prensibinin reddi) hem de niteliklerine göre borçluya hem icra emri hem de ödeme emrinin gönderilebileceği (“yalnızca ödeme emri” prensibinin reddi) savunulmuştur.
In the Turkish law, the mortgage right can be used to guarantee more than one receipt from the same person. According to the nature of the different recipients within the guarantee scope, the execution followings that will be initiated may be subject to different rules as the relevant recipients may also be different. For if the mortgage is guaranteed, one of the receipts may become muaccel before the other, one of these receipts may be the subject of the payment order and the other may be the subject of the execution order. The court has developed the principle of "dispersion of the mortgage right" to solve the issue in these cases. In accordance with this principle, the Court acknowledges that all the recipients under the guarantee must be presented within a single execution follow-up and that (even if the execution order is possible for one of the recipients) the debtor can only be sent a payment order. In the study, the principles of the undivision of mortgage rights have been evaluated separately. Accordingly, contrary to the judgment of the Court, it is defended that if the mortgage right is guaranteed to receive more than one, these recipients may be subject to different execution followings (the "one-following" principle is rejected) and that the debtor can be sent both the execution order and the payment order according to its qualities (the "one-paying" principle is rejected).
