Yargısal uygulaması olmayan Bildirge, daha çok bir metin yorumu olarak anlaşılmaya elverişlidir. İçinde bulunduğumuz koşullardan geriye bakarak Bildirge’yi objektif yorum anlayışı ile okumak, Bildirge’nin benimsediği insanlık idealini kapsayıcı ve ileriye ışık tutucu sonuçlara ulaştırabilir. Bu çerçevede Bildirge, böyle bir ideali yansıtırken, diğer ulusal ve uluslararası belgeler, bunun yalnızca belli aşamalarla ulaşılabilmiş bir kesitini verebilmektedir. Klasik hak ve özgürlüklerle sosyal hakların bir sentezini oluşturan, dolayısıyla insan haklarının bütünlüğünü yansıtan Bildirge, 28. maddesiyle tüm hak ve özgürlüklerin tam olarak gerçekleşmesini, kişinin özgürleştirilmesini amaçlamakta, bunun için toplumsal ve uluslararası bir düzenin kurulmasını öngörmekte ve bu düzenin sağlanmasını kişilerin sübjektif bir hakkı olarak formüle etmektedir. Buna bağlı olarak anayasalarda daha çok devlet ödevi olarak formüle edilmiş olan sosyal hakların “ulusal çaba ve uluslararası işbirliği yoluyla” gerçekleşmesini de sübjektif bir hak olarak düzenlenmiştir. Böylece devletlere aktif bir yükümlülük getirirken, gelişmiş ülkelere de önemli bir sorumluluk yüklemiştir. Bu çerçevede yapılacak somutlaşmanın “her devletin örgüt ve kaynaklarıyla orantılı” olması ise, bu kaynakların sosyal öncelikli alanlara yönlendirilmesi anlamına gelmektedir. Bildirge’de yer alan hak ve özgürlüklerin sınırlanmasında belirleyici amaç, “başkalarının hak ve özgürlüklerinin gereğince tanınması ve bunlara saygı gösterilmesi” ile demokratik bir toplumun standartlarına uygunluğun sağlanmasıdır. Ayrıca, sayılan nedenler “haklı gerek” ölçütüne bağlı kılınmış, “genel refahın haklı gereklerinin karşılanması” gibi sosyal ağırlıklı bir amaçla da dengelenmiştir. Bu çerçevede sınırlama amaç ve nedenleri, ancak sınırlamaya elverişli hak ve özgürlükler açısından geçerli olabilir. Evrensel Bildirge’nin 30. maddesi, “mücadeleci demokrasi” kavramının bir ifadesi olup, ancak zorunlu durumlarda son çare olarak başvurulacak önlemlere cevaz vermektedir.
The statement without judicial application is more convenient to be understood as a text interpretation. Looking back from the circumstances in which we are, reading the Bildirge with an objective understanding of the comment, can bring the ideal of humanity adopted by Bildirge to comprehensive and forward-looking results. In this context, the Declaration reflects such an ideal, while other national and international documents can give a cutting that can only be achieved in certain stages. Declaration, which constitutes a synthesis of social rights with classical rights and freedoms, and thus reflects the integrity of human rights, 28. It aims to the full realization of all rights and freedoms, to the liberation of the person, to the establishment of a social and international order, and to the provision of this order as a subjective right of the persons. Accordingly, the social rights, which are more formalized as a government duty in the constitutions, are also subjective rights to be achieved "through national effort and international cooperation". Thus, while bringing an active commitment to the states, it has also imposed a significant responsibility on the developed countries. If the concretization in this framework is "proportionate to the organization and resources of each state", it means that these resources are directed to social priorities. The main objective of the limitation of the rights and freedoms contained in the Declaration is to ensure compliance with the standards of a democratic society with the "righteous recognition and respect of the rights and freedoms of others". Furthermore, the numbered reasons have been linked to the measure of "fair need" and are also balanced with a social-important purpose, such as "satisfaction of the legitimate requirements of general welfare". In this context, the purposes and reasons of the restriction may only be applicable in terms of rights and freedoms that are restricted. Article 30 of the Universal Declaration is an expression of the concept of “fighting democracy” and refers to the measures to be applied as the ultimate remedy in case of compulsion.
