The term foreigner generally refers to the person, who is not affiliated to the country where he or she lives, by means of citizenship. This term also includes state citizens as well as stateless individuals, immigrants, refugees and other foreigners seeking asylum and special status foreigners. According to the Turkish Laws, the foreigners to whom international protection is provided are those that hold the status of “refugee”, “conditional refugee” and “secondary protection”. Besides, another type of asylum is “temporary protection” which takes place only in case of massive influx. Refugees are those people that are afraid of being subject to oppression due to certain reasons (race, religion, nationality, belonging to a particular social group or political opinions) and that are right about this fear and therefore, not able to stay in their own countries. The basic regulations about refugees are 1951 Convention Relating to the Status of Refugees and its appendix 1967 New York Protocol. The fact that refugees are deprived of the protection of states and are assessed as special status foreigners should be treated delicately. Rights to work and social security are recognized as fundamental human rights. As protected by international conventions and our Constitution; right to work and right to social security exist for everyone irrespective of whether they are citizens and foreigners. In our study, we will deal with the term refugee comprehensively. While we provide information about refugees, we will also mention the other foreigners who are under international protection as well as those holding temporary protection. Subsequently, we will focus on rights to work and social security of applicants and refugees.
