Abstract:

As seen in recent years in Turkey and other developing countries has increased considerably in the number of economic crisis. Especially in these countries that have adopted the floating exchange rate regime, the obligation to pay in foreign currency in import and export transactions causes grievances. In order to eliminate these grievances, alternative payment methods should be considered as a remedy in commercial life. Alternative methods include the exchange of goods and services with other goods and services instead of cash payment in a debt relationship, as in ancient times. Today, systematic reflection of the exchange of goods on commercial relations is qualified within the scope of barter contracts. Barter transactions included in the legislation of many countries around the world have not been adequately addressed in Turkish law. However, instead of payments made in foreign currency with neighboring countries, the exchange with local products and services should be provided with a barter. We believe that this can make a serious contribution to the national economy. Considering the commercial cycle with Russia, the exchange of goods and services through barter transactions rather than foreign currency would alleviate a significant burden of commercial life. In this context, the study will primarily include information about the barter process and the legal nature of this transaction. Then, the work to be done in terms of Turkish legislation and the applicability of the barter agree-ment in trade with Russia will be evaluated.
