Abstract:

The building registration document is a new type of document that has been introduced to our legal literature further to Provisional Article 16, which has been added to Zoning Law No 3194, also known as the “Zoning Peace Law”. This document shall provide for the registration of buildings built in breach of financial obligations and in violation of the law; its purpose is to create a zoning amnesty between the people and the State. In line with this purpose the scope of buildings that can obtain a building registration document has been kept wide and under restricted conditions it provides the possibility of obtaining a registration document by declaration. Although this appears to be compatible with the purpose of the law, it may knowingly or unknowingly result in misapplication. Each misapplication is a candidate for creating legal issues. In order to reduce this possibility or to provide guidance when an issue arises, the conditions of obtaining a building registration document, its legal characteristic, results that accompany it, revocation and other matters that need clarification related to the document are considered with a holistic approach
