Abstract:

Anayasa değişikliklerinin denetimi 1961 Anayasası döneminden bu yana anayasal sistemimizdeçok tartışılan konulardan biri olmuştur. Özellikle Anayasa Mahkemesi’nin verdiği kararlar üzerinden yürüyen bu tartışmalar iki noktada yoğunlaşmaktadır: Anayasa değişikliklerinin denetlenmesi ile ilgili mevcut anayasal düzenlemelerin yorumlanması ve bu şekildeki bir yargısal denetimin mantıki bir temelinin bulunup bulunmadığı. Bu başlık altındaki bir diğer tartışma konusunu ise, halkoylamasına sunulmuş anayasa değişikliği hakkındaki kanunların Anayasa Mahkemesi’nin denetim yetkisi kapsamına girip girmediği oluşturmaktadır.
