Denkleştirme istemi, hukuk sistemimizde 6102 sayılı Türk Ticaret Kanunu’nun kabul edilme-sinden çok önce farklı başlıklar altında tartışılan bir kavramdır. 6102 sayılı Kanun’dan öncede mevcut düzenlemeler kapsamında, belirli bir ölçüde uygulamaya geçirilmeye çalışılmış, bu çerçevede doktrinde ve Yargıtay uygulamasında farklı tartışmalara konu olmuştur. Bu çalış-mada 6102 sayılı Kanun’da yer verilen bu düzenlemenin, Türk Hukuk sistemindeki geçmişi de göz önüne alınmak suretiyle, amacı açıklanmaya ve denkleştirme istemi kavramına bir tanım getirilmeye çalışılmıştır. Bu sırada hükmün içeriği ile uygulaması, uygulamada karşılaşılabilecek bir kısım sorunlarla birlikte, irdelenmiştir.
