Devlet kavramının toplumlara karşı rol ve sorumlulukları zamana ve ideolojiye göre değişip dönüşür. Sosyal devlet kavramı da on dokuzuncu yüzyılda insanlığın zorlu deneyimleri neticesinde ortaya çıkmıştır. Yaşanan mali ve sosyal krizler sonrasında bireyin araç olmaktan çıkıp amaç haline gelmesi ile hukuk devleti, insan onuru, eşitlik, adalet gibi kavramların ön plana çıkması açısından sosyal devlet anlayışı oldukça önemlidir. Türk toplumu yapısı itibariyle daima güçsüzün yanında bir tutum sergilese de anayasal açıdan sosyal devletle tanışılması 1960’lı yılları bulmuştur. İlk kez 1961 anayasasında yer alan sosyal devlet ilkesinin sosyal haklar, demokrasi, toplum refahı gibi konulara katkıları göz ardı edilemez. Türkiye’nin cumhuriyetten önceki ve her yeni anayasa ile değişip dönüşen sosyal devlet politikaları incelendiğinde, gelişmiş ülkelerle karşılaştırılamayacak kadar özgün bir yapıya sahip olduğu ve uygulamaların daha zayıf ilerlediği görülmektedir. Bu çalışmada sosyal devlet kavramı, dünyada ve Türkiye’deki gelişim süreçleri sırasıyla cumhuriyet öncesi dönem ve anayasa dönemleri temelinde incelenmiştir.
The role and responsibilities of the concept of state toward societies change and transform according to time and ideology. The concept of social state also emerged in the nineteenth century as a result of the challenging experiences of mankind. After the financial and social crises, the understanding of the social state is very important in terms of the concept of the rule of law, human dignity, equality, justice. According to the structure of the Turkish society, it has always shown a attitude alongside the weak, but it has been found in the 1960s that it met the social state from a constitutional point of view. The contributions of the social state principle, first included in the 1961 Constitution, to issues such as social rights, democracy, social welfare, cannot be neglected. When the social state policies of Turkey before the Republic and which are changing with each new constitution are examined, it appears that it has an original structure that is not comparable to the developed countries and that the practices are weaker. In this study, the concept of social state, the development processes in the world and in Turkey, respectively, was studied on the basis of the pre-Republican period and constitutional periods.
