Abstract:

The subsidiarity principle, which regulates the sharing of authority and duties between the central and the local governments within the framework of rational principles, it also includes the quality of providing assurance to local government, strengthening their autonomy and increasing the level of public participation, as well as meeting the needs of people met by the units closest to them. The aim of this study is to examine the local government system of Kyrgyzstan in the context of the principle of subsidiarity. As a result of the examination, it has been determined that the Kyrgyz local government is compatible with the principle of subsidiarity in terms of having a wide range of tasks in accordance with the legislation, taking and implementing decisions within the boundaries drawn by the laws, binding of decision for citizens and public institutions and making a judiciary intervention in the event they make a regulation contrary to the legislation. However, it has been determined that the fact that the mayors and head of village administrations can be unseated by the president or “akim” (governor) and their budgets are largely dependent on the general budget tax revenues and equalization benefits transferred by the central government -although they have a wide range of local taxing power, contradict the principle of subsidiarity.
