Memurlar ve Diğer Kamu Görevlilerinin Yargılanması Hakkında Kanunun yürürlüğe girdiği 04.12.1999 tarihine kadar yürürlükte kalan Memurin Muhakematı Hakkında Kanunu Muvakkat (MMHKM), 1913 yılında kabul edilmiş geçici bir kanundur. Memurların yargılanma usulünü düzenleyen MMHKM’nin kabul ettiği sistem soruşturma sistemidir. Bu sisteme göre memurların yargılanabilmesi için idarenin soruşturma yaparak, kovuşturma açılmasına veya yargılama yapılmasına karar vermesi gerekmektedir. Dolayısıyla soruşturma sisteminde idari merciinin görevlendiği muhakkik savcı yetkilerini kullanabilmekte idi. 4483 sayılı Kanununun kabul ettiği sistem ise izin sistemidir. Buna göre memur hakkında Cumhuriyet Savcısı tarafından hazırlık soruşturması yapılabilmesi ve bunun sonucuna göre de kovuşturma açılabilmesi için, yetkili idari merciinin soruşturma izni vermesi, soruşturma izni vermeden önce de mutlaka ön inceleme yapılması gerekmektedir. Bu noktada ön incelemecinin Cumhuriyet Savcısının yetkilerini kullanıp kullanamayacağı gündeme gelmekte ve 4483 sayılı Kanunun 6’ncı maddesinde yer alan “4483 sayılı Kanunda hüküm bulunmayan hallere Ceza Muhakemesi Kanununa (CMK) göre işlem yapılabileceği” yolundaki hüküm çerçevesinde yorum yapılmaktadır. Bu hükmü geniş yorumlayanlar olduğu gibi çok dar yorum yapanlar ve ılımlı yorum yapanlar da bulunmaktadır. Mezkur hüküm yorumlanırken, soruşturma sisteminden izin sistemine geçilmiş olması, muhakkikin veya ön incelemecinin yaptığı çalışmanın hazırlık soruşturması öncesi bir çalışma olması hususlarının dikkate alınması, 4483 sayılı Kanunda CMK’ya yapılan atıf dolayısıyla kanun koyucunun iradesinin mutlaka hesaba katılması gerekmektedir. Ayrıca 4483 sayılı Kanunun kabul edilmesinden sonra yürürlüğe giren CMK’da arama, el koyma, şahısları zorla getirtme gibi temel hak ve özgürlükleri doğrudan ilgilendiren güvenlik tedbirlerine başvurmanın katı kurallara bağlandığı görülmektedir. Bu bağlamda, konu eklektik bir yaklaşımla değerlendirilerek önerilerde bulunulmaktadır.
