Abstract:

In spite of the fact that the proprietary right is regarded as one of the most indispensable human right throughout the history, It’s possible to be restricted like the other fundamental rights. Expropriation process, government and public legal entities apply, while they’re carrying out public services in order to supply property needs, is the most important restriction in the proprietary right. With the expropriation process, the property right of the real estate owner is ruled out. Expropriation process is not only we counter as an administrative act but also its conclusions result in real estate that is subject to private property.Besides expropriation process has both administrative aspects and judicial aspects After it is mentioned the definition , covering and content of the proprietary right which is one of the fundamental and indispensable human right in our study , It is mentioned the basis and procedures in expropriation process that is the fundamental of restrictions
