Aksarâyî olarak bilinen Muhammed b. Muhammed b. Muhammed b. Fahreddin er-Râzî (ö. 791/1389) aklî ve naklî ilimlere hâkim olan çok yönlü bir âlimdir. Tefsir hadis, fıkıh, ahlak ve tıp gibi birçok ilimde tedriste bulunup Arapça, Türkçe ve Farsça olmak üzere farklı dillerde eserler telif etmiştir. Bunların yanı sıra kadılık ve kazaskerlik gibi çok önemli görevlerde de bulunmuştur. Söz konusu görevleri üstlenmiş olması ise onun büyük bir fakîh olduğunu açıkça göstermektedir. Fıkıh ilminde Hâşiye ‘alâ Şerhi Mecma‘i’l-bahreyn ve Şerhu Gâyeti’l-kusvâ gibi müstakil sayılabilecek çalışmalarının dışında müşkil âyet ve hadisler kapsamında hazırladığı el-Es‘ile ve’l-Ecvibe adlı eserinde de ahkâm ile ilgili âyet ve hadislerin fıkhî çözümlemesine değinmeyi ihmal etmemiştir. Her ne kadar söz konusu kitabın asıl kaleme alınma hedefi genel anlamda müşkil veya çelişkili görünen âyet ve hadislerin çözümü olsa da dolaylı olarak fıkhî bazı konulara da değinmiştir. Bu makalede Aksarâyî’nin hayatı ve ilmi kişiliğiyle ilgili kısa bir bilgiye yer verildikten sonra sözü geçen eserinde değindiği fıkhî çözümlemeler aktarılıp metot açısından değerlendirilecektir.
Muhammad b. Muhammad b. Muhammad b. Fahraddin al-Rāzī (d. 791/1389) is a versatile scholar who has specialties in the religious and rational sciences. He has taught and wrote his works in Arabic, Persian and Turkish languages belonging to various fields such as tafseer, hadith, Islamic law, morality and medicine. In addition to this, he has held the important duties, he worked such as Qadi (Muslim judge) and Qadi 'asker (judge of the army). The fact that he undertook these tasks clearly shows that he is a great faqīh (jurist). In addition to his works that can be considered as independent works in the field of fiqh, such as Hashiyah al-Sharh-i Majma'i'l-Bahrain and Sharhu Ghāyeti'l-Qusvā, in the work of al-As'ilah wa al-Ajwibah, he also did not neglect to mention the fiqh analysis of the verses and hadiths about ahkam. Although the main aim of the book was the solution of the verses and hadiths that seem generally contradictory, in this book indirectly addressed some fiqh issues. In this article, after giving a brief information about the life and scientific personality of Aksarayī, we will evaluate his method in the solutions of fiqh issues.
