Covid-19 pandemisi tüm Dünya’da olduğu gibi Türkiye’de insan ve toplum sağlığı yanında, ekonomik ve mali yaşamı olumsuz etkilemiştir. Bu süreci en az hasarla atlatma gayreti ile hükümetler bir dizi önlemler almıştır. Bu önlemler içinde vergisel önlemler de bulunmaktadır. Türkiye’de Hazine ve Maliye Bakanlığı ile Gelir İdaresi Başkanlığı, vergi kanunlarından aldığı yetki çerçevesinde beyan, bildirim (e-yükümlülükler dahil) ve ödeme sürelerinin ertelenmesine yönelik düzenlemeler yapmıştır. Yapılan bu düzenlemelerin vergi hukukunda yer alan mücbir sebepler ve zor durum açısından değerlendirilmesi bu çalışmanın konusunu oluştururken, alınan önlemlerin yeterliliği tartışılmıştır. Vergi mükelleflerinin ertelenen ödeme sürelerinde ödeme sıkıntısı nedeniyle “çok zor durumda” kalmaları halinde başvurabilecekleri tecil müessesesi ve ilerleyen süreçte kabul edilecek potansiyel bir mali af ilave önlemler olarak değerlendirilmiştir.
The Covid-19 pandemic has affected human and social health in Turkey, as well as economic and financial life. With the effort to overcome this process with the least damage, the governments have taken a number of measures. These measures include tax measures. In Turkey, the Ministry of Treasury and Finance and the President of the Income Administration have made arrangements for the delay of the declaration, notification (including e-obligations) and payment periods within the framework of the authority it has received from the tax laws. The assessment of the reasons and difficulties of these arrangements in the tax law is the subject of this work, while the adequacy of the measures taken is discussed. The taxpayers are considered to be an exoneration agency that they can apply if they remain in "very difficult situation" due to paying difficulties during the delayed payment periods and a potential financial compensation that will be accepted in the future process.
