In 17 July 1998, with the participation of several states, the Rome Statute was adopted and opened to signature. With this Statute, It was intended to establish an International Criminal Court to rule on the most serious international crimes, which threaten the existence of all peoples and offend the conscience of international society. The establishment of the Court was completed on 1 July 2002, in accordance with the procedure that was prescribed in the Statute. Article 21 of Statute shows the sources of law that Court shall apply. In accordance with this article, the private law sources of the Court are: “Status, elements of crime, rule of procedure and evidence and case law of court.” The general law sources of the Court are: “applicable international treaties, principles and rules of international law and general principles of law.” The bodies of the court will act considering those above mentioned sources
