Abstract:

Employment Accident Insurance is one of the most important elements of occupational health and safety practices. It is very important to keep up-to-date the work accidents data and report the work accidents to the insurers who suffer from a work accident in accordance with the social security legislation for the purpose of providing the necessary assistance. In Turkey, the obligation to report work accidents has been given to employers and health care providers and if this obligation is not fulfilled in the time specified in the law, administrative penalty, the receipt of temporary work failure payments from the employer and the prohibition of premium promotion have been imposed. However, it is necessary to comply with this obligation and, if necessary, to regulate the administrative penalty, some problems are faced. In this article, the problems that occur in the sanctions practices relating to the obligation to report work accidents in Turkey have been discussed and evaluated for the first time in an academic study.
