Abstract:

It is necessary to examine the pre-modern forms to understand the structure called the “modern state” so that we can understand clearly the modern state as a part of political power. First of all, the modern state is an institutionalized form of political power. In other words, it is the most serious and modern development in political power. In institutionalized forms of political power, law-making and enforcement bodies are different organizations, unlike the stateless societies and the sanctified political power. Anyhow, the unity of law-making and enforcement has been destroyed. The modern state has substantial, rational and juridical characteristics. The spine of the modern state is the legitimate monopoly of violence. The legitimate monopoly of violence is a substantial structure of the state which is composed of sovereignty and boundary. Bureaucracy, which means administrative centralization, reaches a rational nature in the modern state. The juridical structure of the modern state demonstrates to us that the source of legitimacy does not belong to the god and that the citizen supersedes the “tebaa” (vassal)
