1 Nisan 1923’de seçimin yenilenmesine karar veren TBMM’si, Cumhuriyeti resmen ilân etmemesine rağmen görevini büyük bir sorumlulukla yapan tarihî meclis olmuştur. Birinci Büyük Millet Meclisi seçimin yenilenmesine karar vererek dağıldıktan sonra Mustafa Kemal Paşa, yeni meclis toplanıncaya kadar yetiştirilmek üzere bir kısım uzman arkadaşlarını yeni bir Anayasa tasarısı hazırlamakla görevlendirmiş ve zaman zaman toplantılara başkanlık ederek bu yoldaki çalışmaları kendi düşünce ve direktifleri ile aydınlatmıştı. Özellikle konuşmalarında, millî hükümetin mahiyetinin Cumhuriyet olduğu halde onu kesin olarak ifade ve ilân etmemenin devlet idaresinde zaaf olduğunu, ilk fırsatta Cumhuriyeti ilân ederek bu zaafı ortadan kaldırmanın gereğini belirtmişti.
