Abstract:

Uyuşmazlıkların çözümü her hukuk sistemi tarafından yerine getirilmesi gereken en önemli konudur. Aralarında anlaşmazlık yaşayan insanlar, sorunlarını, arabuluculuk, tahkim, sulh ve mahkeme yoluyla çözüme kavuşturmaktadır. Bu makalede uyuşmazlık çözüm yöntemlerinden biri olan arabuluculuğa dikkat çekilmiştir. Arabuluculukla ilgili kavram analizi yapılmış, ayrıca sulh ile diğer uyuşmazlık çözüm yöntemleri karşılaştırılmıştır. İslam hukukunda Arabuluculuğun temellendirilmesi olarak Kur’an’da ve Hz. Peygamberin uygulamalarında arabuluculuk üzerinde durulmuş, Arabuluculuğun işleyiş süreci ve Arabuluculuğun günümüzde uygulanışı ele alınarak, Arabulucuda bulunması gereken şartlar açıklanmıştır. Makale, kanaat ve değerlendirmelerin yer aldığı sonuç kısmıyla bitirilmiştir.
