Abstract:

Development rights are one of the many rights comprising by the concept of private property. The primary goal here is the protection of private property rights and associating to the connection between the public interest. At the present time, based upon the failure to use the reinforcement areas booked in the development plans for the public weal due to the limited number of implementation tools, the property right is restricted and the public interest cannot be accomplished. For the purpose of compensating the forfeitures of the proprietors by specifying the implementation of the development plan via the Transfer of Development Right method, this study aims to develop the TDR system in Turkey.
