So many results that aren't mine?

Abstract:

Kişilerin insan olmanın onuruyla bağdaşır şekilde yaşamalarını sağlamak için devletin sağlaması gereken en temel haklar arasında konut hakkı bulunmaktadır. Bu hak Anayasa’daki çok sayıda hak açısından da vazgeçilmezdir. Zira bu hak yerleşme özgürlüğü, sağlıklı yaşam, çevre ve eğitim gibi haklarla ayrılmaz bir niteliğe ve ilişkiye sahiptir. 1982 Anayasası’nda sosyal haklar arasında sayılan konut hakkı md. 57’de konut hakkı başlığının altında ele alınmıştır. Anayasa’daki düzenlemede, bu hak devlete yüklenen olumlu edim ödevi olarak ele alınmış ancak bu hakkın sınırlama sebeplerine yer verilmemiştir. Bu nedenlerle, konut hakkının sınırlanmasında Anayasa md. 65’teki genel sınırın dikkate alınması gerekmektedir.
