Abstract:

Foreign law shall be exercised in accordance with the rules of conflict of laws in the processes and relations relating to special law that carries the element of foreignity. The identification and enforcement of foreign law is regulated in Law on International Special Law and Procedure Law (MOP) p. In addition, there are agreements on judicial assistance with the European Convention on the Obtaining Information on Foreign Law which our country is a party. The application of foreign law, depending on the definition of case or law in the legal system, is different. According to the law, the judge applies the rules of dispute by the Turkish laws and the foreign law that is competent under these rules. The competent judge may request the assistance of the parties in the determination of the provisions of the foreign law (Court of Justice, p. Our study will examine the role of the parties in the implementation of foreign law in the framework of the Law on International Private Law and Procedure Law, Law on Legal Procedures, International Agreements and Court Decisions.
