Yerel yöneticilerin ve kamu görevlilerinin denetimi ile hesap verebilir, katılımcı ve şeffaf bir yönetim için vatandaşların kamu yönetiminde daha etkin olmasına yönelik çalışmalar devam etmektedir. Bu bağlamda dünya genelinde seçmen denetiminin daha etkin olması ve seçmen denetiminin seçimler dışındaki çeşitli mekanizmalarla temini noktasında da arayışlar sürmektedir. Seçilmiş görevlileri, seçmenlere bağlayan ve vatandaşların ihtiyaçlarına cevap vermeyen/veremeyen seçilmişlere olan kızgınlık ve kırgınlıkların demokrasi ortamında düzeltilebilmesine yardımcı olan “geri çağırma (recall) mekanizması” bugün birçok ülkede uygulama alanı bulmaktadır. Geri çağırma, yaptıkları iş ve işlemlerden memnun olmayan ya da seçim sürecinde verdikleri sözleri yerine getirmeyen kamu görevlilerinin, seçilmiş yetkililerin ve /veya organların belirli orandaki vatandaş tarafından olağan görev süreleri dolmadan görevden alınmalarını sağlayan bir mekanizma olarak demokrasinin kusurlarını örtmede ve halkın katılımını sağlamada önemli bir araç olarak kullanılmaktadır. Bu çalışmada geri çağırma hakkı ile ilgili teorik bilgilere yer verildikten sonra dünyanın farklı ülkelerindeki geri çağırma mekanizmasının düzenlenme biçimleri, uygulanma usulleri ve siyasal sistem üzerinde yarattığı etki ve sonuçlar irdelenmektedir. Bunun yanında Türk Siyasi Hayatında tartışılmaya başlayan geri çağırma mekanizmasının Onuncu kalkınma Planında ve Köy Kanun Tasarısındaki yeri ve Türkiye’de uygulanabilirliği tartışılacaktır.
With the supervision of local managers and public officials, the work is continued to make citizens more effective in public administration for a participatory and transparent administration. In this context, there is an effort to make voter control more effective worldwide and to provide voter control with various mechanisms beyond elections. The “recall mechanism” which helps to repair the anger and anger of elected officials, who connect to voters and who don’t/can’t respond to citizens’ needs in a democratic environment, is now in many countries. The recall is used as a mechanism that enables public officials, elected authorities and/or bodies who are not satisfied with their work and processes or fail to fulfill their promises in the election process to be withdrawn from office by a certain percentage of citizens without the expiry of their ordinary mandate and as an important tool to cover the defects of democracy and to ensure the participation of the public. After the theoretical information on the right to withdrawal is included in this study, the methods of regulation, implementation procedures and the effects and consequences of the withdrawal mechanism in different countries of the world on the political system. In addition, the place of the recall mechanism that begins to be discussed in the Turkish political life will be discussed in the Tenth Development Plan and in the Village Law draft and the applicability in Turkey.
Efforts are underway to ensure that citizens are more active in public administration for accountable, participatory and transparent management through the supervision of local authorities and public officials. The recall mechanism, which connects elected officials to voters and helps neutralize anger and resentment to elected officials who do not respond to the needs of citizens, is found in many countries today. Recall is used as an important tool for covering the flaws of democracy and ensuring public participation as a mechanism that ensures that public officials, elected officials and/or bodies who are dissatisfied with their work or do not fulfill the promises made during the election process are dismissed by a certain percentage of citizens before their normal term of office expires. In this study, after giving the theoretical information about the right of recall, recall practices in different countries of the world will be examined. Besides Turkic tenth place in the political life and Rural Development Plan Draft Law on the recall mechanism began to be discussed will be examined and applicability in Turkey will be discussed.
