Zarar görenin rızası, Türk Borçlar Kanununun 63. maddesinin 2. fıkrasında hukuka aykırılığı ortadan kaldıran bir hukuka uygunluk nedeni olarak düzenlenmiştir. Türk Medeni Kanununun 24. maddesinin 2. fıkrasında da kişilik hakkı zedelenen kişinin rızasının, kişilik haklarına saldırıyı hukuka uygun hale getireceği belirtilmiştir. Rıza kavramının çeşitli mevzuat hükümlerinde yer verilmişse de, bu kavramın tanımı yahut hukuki niteliği mevzuatta düzenlenmemiştir. Bu çalışmada öncelikle rıza kavramının tanımı ve öğretideki görüşler de dikkate alınarak rıza kavramının hukuki niteliği incelenmiştir. Türk borçlar hukukunda kişinin malvarlığı haklarının ve belirli şahıs varlığı haklarının ihlal edilmesine rıza gösterebileceği, gösterilen bu rızanın ihlali ve fiili hukuka uygun hale getireceği düzenlenmiştir. Hukuka aykırılığı ortadan kaldıran hallerin gündeme gelebilmesi için ortada hukuka aykırı bir eylemin olması gerektiğinden ve genellikle bu eylem bir başkasının hakkını yahut kamu düzenini, milli güvenlik genel sağlık gibi çeşitli kategorileri ve menfaatleri ihlal ettiğinden çatışan menfaatler arasında denge kurulması oldukça önemli ve bir o kadar da tartışmalı bir konudur. Bu çalışmada rızanın bir hukuka uygunluk nedeni olarak geçerlilik arz edebilmesi için sağlaması gereken koşullara ve rıza için özellik arz eden bir kısım tartışmalar ele alınmıştır. Gerekli koşulları sağlayan ve geçerlilik taşıyan rıza, fiilin hukuka aykırılığını ortadan kaldıracaktır.
The consent of the person injury is established as a reason for compliance with the law that eliminates the infringement in Article 63(2) of the Turkish Debt Act. Article 24(2) of the Turkish Civil Law also states that the consent of the person who has been denied the right to personality will make the attack to the right to personality legal. Although the concept of consent has been included in various legislative provisions, the definition or legal nature of this concept has not been regulated in the legislation. In this study, first of all, the definition of the concept of consensus and the opinions in the teaching are also considered to the legal nature of the concept of consensus. In the Turkish debt law, it is regulated that the person may consent to the violation of property rights and the rights of a particular person's property, the demonstrated consent will make the violation and the actual law appropriate. The balance between the conflicting interests is very important and a very controversial issue, because it must be a violation of the law in order to get rid of the circumstances that eliminate the violation of the law and that it often violates the rights of another person or the public order, the various categories and interests such as national security and general health. In this study, a part of the discussion has been discussed on the conditions and the characteristics of the consent that the consent must be provided to be valid as a reason for legal conformity. The consent that provides the necessary conditions and holds validity will eliminate the fact’s infringement of law.
