Günümüz döviz piyasalarında bedellerin vadeli olup olmamasına göre “spot (peşin)” ve “türev (vadeli)” olmak üzere iki tür işlem vardır. Spot döviz işlemleri genelde sahip olunan paralarla yapılır. Ancak bankaların müşterilerine ellerindeki para miktarından çok daha fazla miktarda döviz alıp satma limiti tanıdığı durumlar da söz konusudur. Bankacılık literatüründe bu işleme kısaca “marjlı fx” veya “forex işlemi” denmektedir. Forex, döviz alım satımının İngilizce karşılığı olan Foreign Exchnage ifadesinin kısaltılmasıdır. Arap dünyasında el-bey‘u bi’l-hâmiş (البيع بالهامش) adıyla anılır. Esas itibariyle forex, bir ülkenin para birimi karşılığında başka bir ülke parasının alımı ya da satımı olarak tanımlanmaktadır. Marjlı forex işlemi ise bir sözleşme kapsamında bankanın müşteriye, yatıracağı teminat miktarının belirli bir katı kadar döviz alıp satma limiti tanıması olarak tanımlanmaktadır. Forex piyasası, dünyanın hem en büyük hem de en hızlı gelişen finansal piyasalarından birisidir. Bu piyasadaki likidite, dünyanın temel hisse senetleri borsalarının toplamından daha fazladır. Merkez bankaları ticari bankalar, döviz borsaları, yatırım fonları, uluslararası ticaret şirketleri, aracı kurumlar ve özel şahıslar forex piyasasının katılımcılarıdır. Forex işlemini cazip kılan sebepler olmakla birlikte oldukça riskli bir piyasadır. İslam hukukunda sarf akdi kapsamında ele alınan paraların alım satımı konusu üzerinde titizlikle durulmuş, Kitap, sünnet ve genel ilkeler ışığında hukuki çerçevesi belirlenmiştir. Para mübadelesi işlemlerinde İslam hukukçularının en çok üzerinde durdukları husus, her iki bedelin de peşin olmasıdır. İşte kaldıraçlı forex işleminde bedellerin peşin olmaması ve karışık bir muhtevaya sahip olması ve fıkıhtaki sarf akdi prensiplerine uygun düşmeyen unsurlar içerdiği için forexin İslam hukukuna göre geçerli bir işlem olup olmadığı hususu iş dünyasında merak konusudur. Makalemizde kaldıraçlı forex işlemi sarf akdi başta olmak üzere karz akdi, madumun satımı ve safkateyn yasağı açısından tahlil edilecektir.
There are two types of transactions in today’s currency markets, depending on whether the prices are deadly or not, “spot” and “transaction”. In the Arabic world, the name of al-bey is called al-l-hâmiş. In principle, forex is defined as the purchase or sale of the currency of another country in exchange for the currency of one country. Margined forex transaction is defined as a contract that the bank recognizes to the customer the amount of warranty it will deposit up to a certain rate of the exchange and the limit of sale. The Forex market is one of the largest and fastest growing financial markets in the world. The liquidity in this market is more than the total of the world’s main stock exchanges. Central banks are trading banks, exchange exchanges, investment funds, international trading companies, brokers and private individuals are participants in the forex market. For example, Forex trading is a very risky market. In Islamic law, the procurement of money treated in the framework of the expense agreement was rigorously focused on the subject of the sale of money, the Book, the Sunnah and the general principles of the legal framework were determined. The most important thing that the Islamic lawmakers stand on in the exchange processes is that both prices are in advance. Here is the question of whether forex is a transaction in accordance with Islamic law, because the prices are not in advance and they have a mixed balance and they contain elements that are not in accordance with the principles of the expense agreement in the fake is a question of whether forex is a transaction in accordance with Islamic law.
