Abstract:

One of the areas where the function of the ethical principles is most vital is undoubtedly judgment. In a system that does not dominate ethical principles and values, the justice services will not be able to reach justice as a result of the trial process. Although it is known that many different professional hands in Turkey have developed their own professional ethical behavior rules, studies in the field of judicial ethics have begun in the recent past. Since Turkey has no legal ethical rules of conduct seen as a significant lack and is frequently criticized, the issue of the creation of these principles has come to the agenda. Two major projects aimed at determining judicial ethics principles have been completed shortly. The results of both projects have also determined the principles of judicial ethical behavior. The first of these are the Principles of Judicial Ethics prepared by the President of the Court, the second is the Turkish Declaration of Judicial Ethics published by the Council of Judges and Prosecutors. In this study, these two arrangements mentioned were examined by comparing with the Bangalore Judgment Ethics Principles. As a result, the two arrangements were inspired by the Bangalore Principles. However, the Principles of Judgment Ethics are more similar to the Principles of Bangalore according to the Turkish Declaration of Judgment Ethics.
