Abstract:

The concept of politics has since been linked with the concepts of justice in social/political practices; state, law and religion. Mefhûm-u made it necessary that justice is carried out on the basis of religious, moral, legal, political, intellectual and human values, and this has made it necessary for the purposes of the political authority. Each state has its own political legitimacy. In Islam, the main lines of state and political understanding are defined as justice, justice, shura and driving license. In this context, the administration is the rule of justice in the political level of the man/itidali compensation, which is important in terms of religious/islamic law. At this point, Islam makes the normal guidance for justice to find the body in the most fair form. In our study, in the pre-modern period and in the modern world, the Islamic Law predicts or not a political system and how the relationship between religion and politics and justice should be established, the general/found literature and dynamics that are formed around the promise of political justice will be illustrated. The aim of this article is to identify the dynamics of the concepts of religion, justice and politics, which have been subject to intense discussions from the early periods of human history, and with which references they are defended. Evvela the perception of politics and justice in the Western thought world, and then the reward of these concepts in the Islamic world will be studied through the head names.

Siyaset kavramı ötelerden beri sosyo/politik pratiklerde adalet; devlet, hukuk ve din kavramlarıyla ilişkilendirilmiştir. Mefhûm-u adaletin dinî, ahlakî, hukukî, siyasî, fikrî ve insânî değerler bazında gerçekleştiriliyor olması üst/içkin bir gücü gerekli kılmış ve bu haseple siyasi otoritenin elzemliği gündeme gelmiştir. Her devletin kendine has siyasi meşruiyyet telakkisi vardır. İslam’da devlet ve siyaset anlayışının ana hatları adalet, hakkaniyet, şûra ve ehliyet/liyakat olarak belirlenmiştir. Bu bağlamda idare erkinin siyasi düzlemdeki adaleti/itidali taziminde, Din/İslam Hukuku açısından önemli olan adaletin vukûsudur. Bu noktada İslamiyet, adaletin en adilâne formda vücud bulması için üst bir bakış ile normsal rehberlik yapar. Çalışmamızda modern öncesi dönemde ve modern dünyada İslâm Hukuku’nun bir siyasî sistem öngörüp öngörmediği ve din-siyaset-adalet arasında nasıl bir ilişki kurulması gerektiği, buna mukabil siyasi adalet söylemi etrafında teşekkül eden genel/temel literatür ve dinamikler betimsel olarak ele alınacaktır. Bu makalede güdülen amaç, insanlık tarihinin ilk dönemlerinden itibaren yoğun tartışmalara konu olan din, adalet ve siyaset kavramlarının dinamiklerini ve hangi referanslarla savunulduğunu tespit etmektir. Evvela Batı düşünce dünyasındaki siyaset ve adalet algısı, ardında da bu kavramların İslam dünyasındaki karşılığı başat isimler üzerinden incelenecektir.
