Yabancı hakem kararlarının tanınması ve tenfizi konusunda Türkiye’de geçerli olan iki düzenleme vardır: Bunlardan ilki 5718 sayılı Milletlerarası Özel Hukuk ve Usul Hukuku Hakkında Kanun’dur. Diğeri ise Yabancı Hakem Kararlarının Tanınması ve İcrasına İlişkin New York Sözleşmesi’dir. 10.06.1958 tarihli Yabancı Hakem Kararlarının Tanınması ve İcrasına İlişkin New York Sözleşmesi (New York Konvansiyonu) hükümleri Anayasa m. 90 çerçevesinde bir kanunla onaylanarak Türk iç hukukunun bir parçası durumuna getirilmiştir. New York Sözleşmesi, hukukî dinlenilme hakkını hakem kararının tenfizine engel olabilecek bir sebep olarak V/1-b maddesinde düzenleme konusu yapmıştır. New York Sözleşmesi’nde açıkça “iddia ve savunma hakkı” ifadesi kullanılmış olsa da modern zamandaki gelişmeler dikkate alındığında artık bunun yerine “hukuki dinlenilme hakkı” kavramının daha yerinde olması sebebiyle makalemizde bu kavramın kullanılması tercih edilmiştir. Makalemizde hukuki dinlenilme hakkının, bilgilenme, açıklama-ispat hakkı ve dikkate alınma-değerlendirme hakkı unsurlarının New York Sözleşmesi m. V/1-b uyarınca bazı özel kavramlarla (kamu düzeni, silahların eşitliği ilkesi, somutlaştırma yükü, gerekçe ve sürpriz karar verme yasağı ile) ilişkisi Türkiye’deki yargı kararları kapsamında değerlendirilmesi yapılmıştır.
There are two regulations in force in Turkey regarding recognition and the recognition of foreign judgments: the first of them is the International Special Law and Procedure Law Act No. 5718. The New York Convention on the Recognition and Implementation of Foreign Arbitration Decisions. The provisions of the New York Convention on the Recognition and Implementation of Foreign Arbitration Decisions of 10.06.1958 (New York Convention) were approved by a law in the framework of the Constitution p. 90 and made part of Turkish domestic law. Article V/1-b of the New York Convention provides that the right to legal rest may be prevented by the judgment as a reason. Although the New York Convention has clearly used the term "right and right to defense" but, taking into account the developments in modern times, it is now preferred to use this term in our article because the concept of "right to lawful rest" is more in place. In our article, the relationship between the legal right to rest, the right to information, the right to explanation and the right to consideration and the right to evaluation in accordance with the New York Convention m. V/1-b with some specific concepts (the public order, the principle of equality of weapons, the burden of formulation, the prohibition of judgment of reason and surprise) was assessed within the framework of court decisions in Turkey.
