So many results that aren't mine?

Abstract:

Özet Joseph Raz, hukukun otorite iddia ettiğini savunarak ve bunun bütün hukuk sistemlerinin doğasında bulunan bir gerçeklik olduğunu kabul eder. Ona göre hukuk her ne özelliğe sahip olursa olsun, doğası gereği otorite iddia etmektedir. Raz’a göre hukukun otoritesi açısından önemli olan hukukun hizmet fonksiyonudur. Hukuk, özneleri ile doğru eylem sebeplerini buluşturarak, öznelerin yararına aracılık etmektedir. Dolayısıyla hukuk otorite olmakla bizzat değer yaratmayıp değerli yaşamı temin eden en iyi araçtır. Raz’ın hukuka böyle bir statü yüklemesi ve hukukun içeriğini sosyal olgulara dayandırması ona pozitivist ve anti-pozitivist bir görünüm katar.
