Abstract:

Developments in electronic technology and using internet by mass people introduced new types of works such as computer programmes and electronic data bases together with new communication and trade methods. This progress brought new infringement of the works. Nevertheless; beyond using the work as content, on line publishing in internet obliges technological corporation. This publishing can be possible by the integration of technical stages like; providing the content, hosting the content, access the content. Beyond the providing the content, on line service providers are under legal action threat by reason of hosting and accessing the contents which are provided by third parties copyright infringements. Leading of USA and EU, the torts which are occurred by third parties copyright infringements on conclusion of law were enacted. However, the legal subject was exclusively handled by criminal law and subject matter of the liability and nonliability of internet service providers that are because of third parties copyright infringements were neglected by law no: 5651 in our country.
