İslam hukuk tarihinde akılcılık denildiğinde akla ilk gelen şahsiyet kuşkusuz Ebû Hanîfe’dir. Ebû Hanîfe’nin akılcılığı aklın bilginin kaynağı olması anlamında de- ğil, nasların yorumlanmasında akla biçilen rolün diğer mezheplere göre daha fazla olması manasındadır. Ebû Hanîfe, kişilik özelliklerinin, entelektüel birikiminin, toplumsal hayatın içinde olmasının, mensubu olduğu bilimsel geleneğin hocalara bağlılık özelliği taşımasının, mezhep içi hükümlerde bütünlük ve tutarlılık arayışının ve bir takım çevresel faktörlerin sonucu olarak nasların yorumlanmasında akılcı (reyci) bir tutum izlemiş ve bu özelliği ile temayüz etmiştir. Bunun sonucu olarak da ictihad faaliyetlerinde kıyas ve istihsan gibi aklı kul- lanmayı gerektiren yorumlama biçimlerini yoğun bir şekilde kullanmıştır.
The person who first comes to mind when the topic is the concept of rationality in the history of Islamic law, that per- son is, undoubtedly, Abu Hanifa. The rationality of Abu Hanifa does not mean that the ration is the source of knowledge but rather the role of reason- ing in the interpretation of nusus is greater than in other sects. As a result of his personality traits, intellectual accumulation, being an active member of the social life, loyalty of his scientific tradition to scholars, his search for integrity and coherence in sectarian rules and some other environmental fac- tors, Abu Hanifa followed a rational attitude (using and applying ra’y) in the interpretation of nusus, and he came into prom- inence with this ratio- nality-centered feature. Therefore, he intensely used forms of interpreta- tion that require the use of reasoning such as qiyas and istihsan in his ijtihad activities.
