Abstract:

With the development of democracy in public administration and the understanding of participation began to be discussed, transparency in the administration came to the forefront. In the public administration, the thought of accountability has brought with it the principle of clarity in the administration. As in many developed countries, legislative arrangements have been made in order to implement the understanding of transparent governance in both Germany and Turkey. The main claim of the work prepared from here is that the principle of transparency is to be placed, by breaking the tradition of privacy in public administration, the work of public reconstruction and the principle of public administration. In Turkey and Germany, a comparative settlement of the regulations established in order to be able to place the principle of transparency in the administration within the administrative and legal system is the main objective of the work. The study prepared for this purpose was used by the comparative analysis method, the primary and secondary sources related to the subject. In the framework of the work prepared in this method axis, the issue of privacy and transparency in public administration is discussed, the provisions for transparency in the Turkish public administration are examined, the "Law on the Right to Information" is assessed. Through the "Administrative Procedure Act" and the "Federal Information Acquisition Act" information is provided on the practices of transparency in the administration in Germany. The study is concluded with a comparative analysis of the legislation based on the practices of transparency in the administration of the two countries.
