There are several principles that have to be cared for while performing criminal procedures. The existence of these principles requires being a democratic state of law respecting human rights. The Presumption of Innocence is a principle that has been included in judicial processes as an element of the right to a fair trial both in the Constitution and in the European Convention on Human Rights. In this study this principle will be examined both in constitutional context and with the European Human Rights Convention dimension. In addition, the norms on the Presumption of Innocence principle in the Turkish Penal Legislation will also be investigated, and the decisions of the European Court of Human Rights on this topic will be examined
