Bu çalışmada emtia türevlerinden emtia forward, emtia futures ve emtia opsiyon sözleşmeleri yerine çağdaş İslam hukuku literatüründe önerilen alternatif yöntemler ve bunların değerlendirilmesi yapılmıştır. Çağdaş İslam hukukçularının çoğunluğu mezkûr sözleşmelerin caiz olmadığı kanaatindedir. Bu sebeple bu sözleşmeler yerine önerilecek alternatiflerin tespit ve tahlili önemlidir. Çalışma iki ana bölümden oluşmaktadır. Birinci bölümde emtia forward ve emtia futures sözleşmelerin alternatifleri, ikinci bölümde emtia opsiyon sözleşmelerinin alternatifleri incelenmiştir. Emtia forward ve emtia futures sözleşmelerin alternatifi olarak önerilen yöntemlerin bir kısmı klasik bir kısmı çağdaş yöntemlerdir. Klasik yöntemler arasında selem akdi, vadeli satım akdi ve istısna‘ akdi vardır. Çağdaş yöntemler arasında ise paralel selem, paralel istısna‘ ve sukuk bulunmaktadır. Emtia opsiyon sözleşmelerinin alternatifi olarak önerilen yöntemlerin tamamı ise klasik yöntemlerden oluşmaktadır. Bunlar arasında muhayyerlik şartıyla satım akdi, kaparolu satım akdi, selem akdi, vadeli satım akdi ve istısna’ akdi sayılabilir.
In this study, alternative methods suggested instead of commodity forward, commodity futures and commodity option contracts in contemporary Islamic law literature are evaluated The majority of contemporary Islamic jurists are of the opinion that the aforementioned contracts are not permissible. For this reason, it is important to identify and analyze the alternatives to be proposed instead of these contracts. The study consists of two main parts. In the first part, alternatives of commodity forward and commodity futures contracts, in the second part, alternatives of commodity options contracts are examined. Some of the methods proposed as alternatives to commodity forward and commodity futures contracts are classical and some are contemporary methods. Among the classical methods, there are salam contract, forward (credit) sales contract and istisna' contract. Contemporary methods include parallel salam, parallel istisna' and suq̣ūq. All of the methods proposed as an alternative to commodity option contracts consist of classical methods. Among these, sale contract on condition of discretion, down payment contract, sale contract, forward (credit) sale contract and istisna' contract can be counted.
