Aile birleşimi, menşe devlet ülkesinde yasal olarak ikâmet eden bir yabancının, aile üyelerinin, bu devlette aile birliğinin oluşması için, ailenin meydana gelişinin ikâmet edenin, ülkeye girişinden önce ya da sonra olmasına bakılmaksızın, aile birliğini korumak üzere ev sahibi devlete girişi ve ikâmet etmesidir. Bu sayede, yabancının Avrupa Birliği’nin temel amaçları doğrultusunda sosyal ve ekonomik uyumu da temin edilmeye çalışılmaktadır. Yürürlükteki mevzuatta üye devlet vatandaşları ile üçüncü devlet vatandaşları açısından aile birleşiminin şartları ve sonuçları farklı şekillerde düzenlenmiştir. Diğer yandan, Türk vatandaşlarının aile birleşimine ilişkin öncelikle ve doğrudan Ortaklık Mevzuatı uygulanmaktadır. Avrupa Birliği Adalet Divanı ise aile birleşimini Avrupa İnsan Hakları Sözleşmesi ve Avrupa İnsan Hakları Mahkemesi kararları ışığında temel hak olarak kabul etmekte ve aile birleşimine ilişkin bu farklı düzenlemelere dair uyumlaştırıcı kararlar almaktadır. Bu çalışmanın temel amacı, üçüncü devlet vatandaşlarının aile birleşimine ilişkin Avrupa Birliği Adalet Divanı kararlarını incelemektedir.
Family unity is the entry and residence of a stranger who legally resides in the country of origin, the family members, in order to form a family unity in that country, the resident of the family unity, before or after entering the country, to protect the family unity. Thus, it is also sought to ensure the social and economic consistency of the foreigner in accordance with the main objectives of the European Union. In the current legislation, the conditions and consequences of family unification for citizens of the Member State and third-country nationals are regulated in different ways. On the other hand, the Partnership Regulation on the unification of the family of Turkish citizens is primarily and directly applied. The Court of Justice of the European Union recognizes family unification as a fundamental right in the light of the decisions of the European Convention on Human Rights and the European Court of Human Rights and adopts harmonizing decisions on these different arrangements relating to family unification. The main objective of this study is to examine the decisions of the European Union Court of Justice concerning the family unification of third-country nationals.
Family reunification means the entry into and residence in the host state by family members of State of origin national residing lawfully in that host state in order to preserve the family unit, whether the family relationship arose before or after the resident's entry. In this way, it is endeavored to facilitate the social and economic adaptation of foreigners in line with fundamental European Union objective. Conditions and results of family reunification on European Union citizens and third-country nationals are differently arranged under the legislation in force. On the other hand, Association Legislation is primarily and directly implemented in family reunification of Turkish citizens. Court of Justice of the European Union acknowledges that family reunification is fundamental right in the light of European Court Of Human Rights judgements and takes reintegrative decisions about these different regulations. The main purpose of this study is to examine the Court of Justice of the European Union decisions on family reunification of third-country nationals.
