Abstract:

Misconduct and misuse of duty are crimes committed by public officials or officials and resulting in damages to the public, which are defined as crimes in the law. The forest engineers who work in the state forest operations are also under the law of the Republic of Turkey in the status of state officials and have all rights, powers, duties and responsibilities recognized to the officials. This study aimed at the study of examples of events in which forest engineers working in the state forest enterprises are committed by the misconduct and misconduct of their tasks. For this purpose, the cases in which forest engineers who are accused of missing their duty and abusing their duty while in office in the state forest operation have been chosen among many high court decisions. Examples obtained from the electronic law database 110 Court ruling has been detailedly analyzed and grouped according to the subjects. The assessment resulted in the fact that the task of the forest processing bosses is to ignore the crimes in which many of the cases are committed, due to the lack of custody against the forest crimes. In the case of the offence of abuse, it has been found that the position and authorities of the accused are due to their desire to use their powers to provide unfair profits against individuals or other persons. In order to reduce or even disappear these crimes, it is necessary that officials know very well the rights, powers, duties and responsibilities granted to them and that they do not interfere with the actions that result in the crime.
