Kur’an ve sünnette evlilik ayrı bir öneme haizdir. İslam da aile birliğinin korunması ve sürekli bir evlilik hedeflenir. Evliliğin sürekliliği karşılıklı sevgi, saygı, özveri ve hoşgörüye bağlıdır. Hayatın akışı içerisinde aile içi kırgınlık ve anlaşmazlıkların olması doğaldır. Bu anlaşmazlıkları eşlerin kendi arasında konuşup anlaşarak çözmeye çalışmaları esastır. Eşlerin kendi aralarındaki problemleri çözmeye gücü yetmediği takdirde Kur’an ailenin devamı için karı kocaya birtakım tedbirler önerir. Ailenin parçalanmasını, ani refleksle alınan fevri kararların telafisi imkânsız sonuçlarını aza indirgemek için sunulan bu tedbirlerin bir aşamasını da Hz. Peygamber ve Sahabe dönemlerinden sonra önemini yitiren ve aktif olarak kullanılmayan tahkim kurumu oluşturmaktadır. Bu aşamada aile birliğinin dağılmasını önlemek için hakem gönderilmesi ve tarafların yakın çevresinin bu birlikteliği muhafaza etmek için aktif rol üstlenmeleri emredilir. Modern hukukta da “Hukuk Usulü Mahkemeleri Kanunu” sekizinci babı 516-536. maddelerinde detaylandırılmasına rağmen tahkim kurumu, ticari sorunların çözümünde görmüş olduğu ilgiyi Medeni Kanun’da görmemiştir. Aile içi problemlerin ve mağduriyetlerin çoğalması ve normal mahkemelerin zaman ve bilgi açısından yetersiz kalması sebebiyle 2003 yılında aile mahkemeleri kurulmuştur. Ancak aile mahkemelerinin kurulması boşanma oranlarının çoğalmasına engel olamamıştır. Konunun tekrar gündeme getirilerek boşanma oranlarının her geçen gün yükseldiği ülkemizde tahkim kurumuna işlerlik kazandırılması aile birlikteliğinin devamı açısından önem arz etmektedir.
In the Qur’an and Sunnah marriage is a separate importance. The Islam is also aimed at preserving family unity and a permanent marriage. The continuity of marriage depends on mutual love, respect, devotion and tolerance. It is natural that in the course of life there are family anguish and disputes. It is essential that the spouses talk and try to resolve these disputes by agreement. If the spouses are not able to solve the problems between themselves, the Qur’an suggests the spouse to the spouse a number of measures for the continuation of the family. A phase of these measures is also offered to minimize the unlikely consequences of the family’s breakdown, the reimbursement of the favourite decisions taken by sudden reflection. The Prophet (peace and blessings of Allah be upon him) and the Prophet (peace and blessings of Allah be upon him) are the people of the world. In this phase, it is ordered to send judges to prevent the breakdown of family unity and to take active role in preserving this unity from the close surroundings of the parties. In modern law, even though the "Law of Legal Procedure Courts" is detailed in chapter eight of articles 516-536, the arbitration body has not seen the interest it has seen in solving commercial problems in the Civil Law. Family courts were established in 2003 due to the multiplication of family problems and victims and the lack of time and information of ordinary courts. However, the establishment of family courts did not prevent the rise of divorce rates. The issue is re-established and the rate of divorce is increasing every day in our country where the arbitration agency is given work in terms of continued family unity.
Marriage has a special importance in the Qur'an and the sunnah. In Islam preservation of family unity and a permanent marriage are aimed. The continuity of marriage depends on mutual love, respect, devotion and tolerance. It is natural for family resentments and conflicts to occur in the course of life. It is essential that the spouses try to resolve these disagreements by talking and agreeing between them. If the spouses are not able to solve the problems among themselves, the Qur’an proposes some measures to the husband and wife for the continuation of the family. The third stage of these measures, which were introduced to minimize the disintegration of the family and the irreparable consequences of impulsive decisions taken with a sudden reflex, is the arbitration institution that lost its importance after the times of the Prophet Muhammad and Companions. In order to prevent the breakdown of the family union, the arbitrators are ordered to be sent and the close circle of the parties to take an active role in maintaining this union. In modern law, although the details are given in the articles 516-536 of the 8th chapter of the "Code of Civil Procedure", the arbitration institution has not received the attention it has received in the solution of commercial problems in the Civil Code. Family courts were established in 2003 due to the proliferation of family problems and grievances and the insufficient time and information of regular courts. However, the establishment of family courts has not prevented the increase in divorce rates. It is imperative to take measures through arbitration in our country, where divorce rates are increasing day by day by bringing the issue back to the agenda
