Özet:

Amnesty institution essentially is regulated in article 87 and 104 of the 1982 Constitution as well as, is handled with technical aspect in the first book of third part of fourth section that is entitled ''reduced the trial and punishment'' of the TCC No 5237. Today this institution, has a very old history, finds application areas in the many country with different motives. Amnesty was organized by going to a distinction in the shape of general and special amnesty in Turkish law. Results vary according to general or special of amnesty and depend on the type of amnesty either discontinues of action or a conclusive criminal conviction disappear with all legal consequences or just execution partially or completely of a conclusive penalty prevents or turns to another penalty. In our legislation there are gaps and contradictions between articles that located amnesty besides amnesty sometimes was used except for the purpose of amnesty, cause to exposure to justified criticism of these institutions
